LOBBYIST REPORT  …..  February, 2010

The 2010 Legislative Session is well underway.  I am writing this on the 17th of 40 legislative days.  277 House bills and 196 Senate bills have been submitted for consideration.

The big topic of discussion is the Budget.  The Appropriations Committee is looking for approximately $40 million in cuts.  They do not want to raise taxes or utilize reserve funds.  Their reasoning at this time is that the  budget, for next year (everything being equal), will have a $107 million dollar shortfall.  The debate will be interesting especially in the Senate with 4 members, counting the Lt. Governor, running for Governor.  It seems the consensus is that the budget will be again settled in the last week.

We are monitoring a number of bills ranging from taxes; court records filing and fees; voidability of gambling contracts; garnishments; credit cards; limited liability company & trusts:

HB 1070  clarifies the voidability of debts passed 66-3 and now goes to the Senate.

HB 1080  revises automation surcharges for the court system.  They need $11 million over the next 5 years for a new information system.  The fees would be doubled and then sunset in 5 years.

HB 1092  extends the garnishment time period for re-filing from 60 to 120 days and has moved out of the House, to the Senate.

HB 1123
 that would have repealed the Bank Franchise Tax was moved to the 41st day.

HB 1221
 would expand the authority of the State Auditor and Treasurer to monitor public funds in local banks.

SB 81 would make the business of open loop credit cards more competitive in our state.   Open loop is like cash in your pocket and can be used in any store that accepts Mastercard or Visa.  Closed loop is like a gift card. The bill passed out of Senate committee 7-0.

SB 119     would have allowed auctioneers to charge for an opinion of value, however it was defeated in committee 7-0.

SB 173 limits interest rates on payday lenders.  Banks may be amended into it.
